That was essentially my original cheat, then my friend pointed out  
this simple modification to get to 8 bytes:

 > cat a
$><<`a`

 > ruby a
$><<`a`

 > which a
/usr/local/bin/a

 > cat `which a`
#!/usr/bin/env ruby
puts '$><<`a`'
